Terms of Use

These Terms of Use (“Terms”) govern your access to and use of themaketa.com, our online courses, community features, and related services (collectively, the “Services”) operated by The Maketa (“we,” “us,” or “our”). By creating an account, enrolling in a course, or otherwise using the Services, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Services. By using the Services, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at response@themaketa.com if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms or pose a security risk.

3. Course access and licence

When you enroll in a course — free or paid — we grant you a personal, limited, non-exclusive, non-transferable licence to access course materials for your own learning. Unless we state otherwise in writing, this licence is for individual use only.

You may not, without our prior written consent:

  • Share, resell, redistribute, or publicly display course content
  • Record, download (where not expressly permitted), or reproduce lessons
  • Use course materials to create a competing product or service
  • Share your account credentials with others

Course content, including videos, text, graphics, and downloads, remains our intellectual property or that of our licensors.

4. Payments and refunds

Paid courses are billed in Nigerian Naira (₦) unless stated otherwise. Payments are processed by Paystack or other authorised payment partners. By completing a purchase, you authorise us and our payment provider to charge the amount shown at checkout.

Prices, offers, and course availability may change at any time. Unless required by applicable law or explicitly stated on the course page, all sales are final and purchases are generally non-refundable once access is granted. If you believe a charge was made in error, contact us within 7 days at response@themaketa.com.

5. Community and user content

Some features allow you to post comments, questions, or other content (“User Content”). You retain ownership of your User Content, but you grant us a worldwide, royalty-free licence to use, display, and store it as needed to operate the Services.

You agree not to post content that:

  • Is unlawful, harassing, defamatory, obscene, or discriminatory
  • Infringes intellectual property or privacy rights
  • Contains spam, malware, or misleading information
  • Promotes unrelated products or services without permission

We may remove User Content or restrict access to community features at our discretion, without notice, if we believe these Terms have been violated.

6. Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Interfere with or disrupt the Services, including through automated scraping or bots
  • Misrepresent your identity or affiliation
  • Circumvent payment, access controls, or technical restrictions

7. Educational disclaimer

Our courses and content are provided for general educational and informational purposes. They do not constitute legal, financial, tax, or professional advice. Results from applying any strategies discussed are not guaranteed. You are solely responsible for decisions you make based on course content.

8. Third-party services

The Services may integrate with or link to third-party platforms (such as social login providers, payment processors, or live session tools). Your use of those services is subject to their own terms and policies. We are not responsible for third-party services we do not control.

9. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE MAKETA AND ITS DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ₦10,000.

12. Indemnification

You agree to indemnify and hold harmless The Maketa from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your User Content, or your violation of these Terms.

13. Suspension and termination

We may suspend or terminate your access to the Services at any time if you breach these Terms or if we discontinue the Services. You may stop using the Services at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Material changes may be communicated by email or a notice on the site. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Nigeria, unless applicable law requires otherwise.
